1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and bdeshConnect ("Company", "we", "us", or "our") concerning your access to and use of the bdeshConnect website and services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms, our Privacy Policy, and the terms of our third-party providers including Airalo, Uber, and accommodation partners. If you do not agree to these Terms, you must not access or use our Services.

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use of the Services after such changes constitutes acceptance of the modified Terms.

2. Eligibility and Account Registration

To use our Services, you must:

• Be at least 18 years of age or have parental/guardian consent
• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept full responsibility for all activities under your account
• Have an eSIM-compatible device (for eSIM purchases)

You must immediately notify us of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to comply with these security obligations.

3. Description of Services

bdeshConnect operates as an authorized reseller facilitating the sale of international connectivity and travel products including:

3.1 eSIM Products (via Airalo)

• International eSIM plans for 200+ countries and regions
• Data-only, voice + data, and unlimited data plans
• QR code delivery for instant eSIM installation
• Regional and global eSIM packages

eSIM Compatibility: eSIMs require a compatible, carrier-unlocked device. Check your device compatibility before purchase. Once an eSIM is installed and activated, it cannot be refunded. See our eSIM Installation Guide for details.

3.2 Uber Vouchers

• Uber ride credit vouchers for various countries
• Digital voucher codes delivered via email
• Redeemable through the Uber app

Uber Voucher Terms: Uber vouchers are subject to Uber's Terms of Service and geographic restrictions. Vouchers must be redeemed in the specified country/region and may have expiration dates. bdeshConnect is not responsible for Uber service availability or changes to Uber's policies.

3.3 Accommodation Services

• Student accommodation listings via Amber Student (UK, US, Australia, Canada)
• Student accommodation listings via Uni Places (Europe)
• Verified properties across major university cities worldwide
• Direct booking support and consultation

Accommodation Terms: Accommodation bookings are subject to availability and the terms of our accommodation partners (Amber Student and Uni Places). bdeshConnect acts as a facilitator connecting you with these trusted accommodation providers. Booking confirmations, cancellation policies, and refund terms vary by property and are governed by the respective partner's terms of service.

3.4 Third-Party Provider Terms

By purchasing products through bdeshConnect, you also agree to the terms and conditions of our third-party providers:

bdeshConnect acts as an authorized reseller. We are not affiliated with, endorsed by, or a subsidiary of Airalo or Uber Technologies Inc. All product names, logos, and brands are property of their respective owners.

4. Pricing, Payment, and Taxes

4.1 Pricing: All prices are displayed in Bangladeshi Taka (BDT) and include all applicable taxes unless otherwise stated. Prices for international currency transactions via Stripe are converted at prevailing exchange rates.

4.2 Payment Methods: We accept payments through Stripe, supporting credit/debit cards and supported digital wallets.

4.3 Payment Processing: Payment must be completed in full before digital products are delivered. All transactions are processed securely through PCI DSS compliant payment gateways. We do not store your payment card information.

4.4 Price Changes: We reserve the right to modify prices at any time without prior notice. Price changes do not affect orders already placed and confirmed.

4.5 Taxes: Prices include Value Added Tax (VAT) as required under Bangladesh VAT and Supplementary Duty Act 2012. For Australian customers, prices include Goods and Services Tax (GST) where applicable under Australian tax law.

5. Refund and Cancellation Policy

5.1 eSIM Refund Policy

Due to the nature of digital products, eSIM refunds are subject to the following conditions:

• Eligible for Refund: eSIMs that have NOT been installed or activated on any device
• NOT Eligible for Refund: eSIMs that have been scanned, installed, or activated (even partially)
• NOT Eligible for Refund: Issues caused by incompatible or carrier-locked devices
• NOT Eligible for Refund: User error during installation or configuration

This policy aligns with Airalo refund policies. We recommend verifying device compatibility before purchase.

5.2 Uber Voucher Refund Policy

• Eligible for Refund: Unredeemed vouchers within 7 days of purchase
• NOT Eligible for Refund: Vouchers that have been redeemed (fully or partially)
• NOT Eligible for Refund: Expired vouchers

5.3 Refund Process

To request a refund, contact our support team at support.enquiries@bdeshconnect.com with your order ID. Approved refunds are processed within 5-10 business days to the original payment method.

6. Product Delivery and Fulfillment

6.1 eSIM Delivery: eSIM QR codes and installation details are delivered electronically via email immediately after payment confirmation. eSIM details are also accessible through your account dashboard.

6.2 Uber Voucher Delivery: Uber voucher codes are delivered via email within 5-30 minutes of payment confirmation.

6.3 Delivery Confirmation: You will receive an email confirmation containing your order details, invoice, and digital product code(s) or QR codes.

6.4 Non-Delivery: If you do not receive your product within 2 hours, contact our support team immediately with your order ID. We will investigate and resolve the issue within 24 hours.

7. eSIM Usage Terms and Conditions

By purchasing an eSIM through bdeshConnect, you acknowledge and agree to the following:

7.1 Device Requirements

• Your device must be eSIM-compatible (iPhone XS or later, Google Pixel 3 or later, or equivalent Android devices)
• Your device must be carrier-unlocked
• You are responsible for verifying compatibility before purchase

7.2 Activation and Usage

• eSIMs must be installed using the QR code provided
• Data allowances and validity periods begin upon activation in the destination country
• Network coverage depends on local carrier partnerships
• Speed throttling may apply after fair usage limits are reached
• Some plans are data-only and do not include voice calls or SMS

7.3 Prohibited eSIM Uses

• Reselling or sharing eSIM credentials
• Using eSIM for illegal activities
• Attempting to bypass network restrictions
• Excessive bandwidth consumption that affects network performance

Violation of these terms may result in immediate termination of your eSIM without refund.

8. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Services for any illegal purpose or in violation of any laws
• Engaging in fraudulent transactions or using stolen payment information
• Attempting to gain unauthorized access to our systems or other users' accounts
• Reselling eSIMs, vouchers, or other products for commercial profit without written authorization
• Creating multiple accounts to abuse promotions or circumvent restrictions
• Reverse engineering, decompiling, or attempting to extract source code
• Transmitting viruses, malware, or other harmful code
• Harassing, threatening, or impersonating other users or staff
• Scraping, data mining, or automated data collection without permission
• Sharing or transferring eSIM QR codes or voucher codes to unauthorized parties

Violation of these prohibitions may result in immediate account termination, forfeiture of pending orders, and potential legal action.

9. Intellectual Property Rights

All content on the Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of bdeshConnect or its content suppliers and is protected by Bangladesh and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Airalo® and Uber® are registered trademarks of their respective owners. bdeshConnect is an authorized reseller and is not affiliated with, endorsed by, or sponsored by these companies. Use of these trademarks is for identification purposes only.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content without our express written permission.

10. Limitation of Liability and Disclaimers

10.1 Service Availability: The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee uninterrupted, timely, secure, or error-free service.

10.2 eSIM and Network Disclaimers: We do not warrant:

• Network coverage or signal strength in any location
• Data speeds or connection reliability
• Compatibility with all devices or carrier configurations
• Third-party network availability or service quality

10.3 Uber Voucher Disclaimers: We are not responsible for:

• Uber service availability in your area
• Changes to Uber pricing or policies
• Issues with Uber app or ride experience

10.4 Limitation of Liability: To the maximum extent permitted by law, bdeshConnect and its directors, officers, employees, and agents shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Third-party provider (Airalo, Uber) issues, outages, or policy changes
• Unauthorized access to or alteration of your data
• Actions or inactions of third-party payment processors

10.5 Maximum Liability: Our total liability for any claim arising from your use of the Services is limited to the amount you paid for the specific product giving rise to the claim, not to exceed BDT 10,000 or AUD 200.

11. Governing Law and Dispute Resolution

11.1 Governing Law: These Terms are governed by and construed in accordance with the laws of Bangladesh. For Australian customers, these Terms are also subject to the Australian Consumer Law where applicable.

11.2 Jurisdiction: You irrevocably submit to the exclusive jurisdiction of the courts of Dhaka, Bangladesh for the resolution of any disputes. Australian customers may also bring proceedings in their local jurisdiction.

11.3 Dispute Resolution: Before initiating formal legal proceedings, you agree to first attempt to resolve disputes through our customer support system. We will make reasonable efforts to resolve complaints within 30 days.

11.4 Arbitration: If informal resolution fails, disputes may be submitted to binding arbitration under the Bangladesh Arbitration Act 2001, with proceedings conducted in English in Dhaka.

12. Account Termination

We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, without notice or liability, for any reason, including but not limited to:

• Violation of these Terms or third-party provider terms (Airalo, Uber)
• Fraudulent or illegal activity
• Providing false information
• Abusive behavior toward staff or other users
• Excessive chargebacks or payment disputes
• Unauthorized resale of products

Upon termination, your right to use the Services immediately ceases. Pending orders may be cancelled, and access to your account and order history may be revoked. Activated eSIMs will continue to function until their validity expires.

13. General Provisions

13.1 Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and bdeshConnect.

13.2 Severability: If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect.

13.3 Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

13.4 Assignment: You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
